RE: The tariff classification of women’s blouses from Indonesia and China

Dear Ms. Gong:

In your letter dated November 14, 2005, you requested a classification ruling. The submitted samples will be returned to you as requested.

Style ETBL9K is a women’s sleeveless blouse made from 100 percent polyester chiffon woven fabric. The lined, pullover garment extends below the waist and features a deep v-neckline and empire styling. The shoulder coverage is over 2 ½ inches.

Style ELZRYS is a women’s sleeveless blouse made from 100 percent polyester chiffon woven fabric. The lined, pullover garment extends below the waist and features a v-neckline with a snap closure and a shaped bodice. The shoulder coverage is less than 2 ½ inches.

The applicable subheading for style ETBL9K will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of man-made fibers: other: other: other: women’s. The duty rate will be 26.9 percent ad valorem.

The applicable subheading for the style ELZRYS will be 6211.43.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, women’s or girls’: of man-made fibers: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded from heading 6206: other. The duty rate will be 16 percent ad valorem.
