RE: The tariff classification of a woman’s pullover from Mexico

Dear Ms. Gradilla:

In your letter dated November 1, 2005, you requested a classification ruling on behalf of Gianno Company, LTD.

Your sample, style 214000242, is a woman’s pullover constructed from 47% polyester, 47% cotton, 6% spandex knit fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction in which the stitches were formed. The garment features a hood, long sleeves with rib knit cuffs, kangaroo pockets at the front, and a 4½-inch rib knit bottom.

The applicable subheading for style 214000242 will be 6110.30.3055, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: other: women’s. The duty rate will be 32% ad valorem.
