RE: The tariff classification of a tackle bag with storage boxes from China

Dear Ms. Watgen:

In your letters dated October 4, 2005 and August 17, 2005 you requested a tariff classification ruling.

The submitted sample is identified as style 3364, a soft-sided tackle storage system. The tackle storage system consists of a soft-sided tackle bag and four model 3650 Stowaway® utility boxes. The soft-sided tackle bag is wholly made-up of man-made fiber textile materials. The Stowaway® tackle box is wholly of translucent molded plastics and is capable of being divided into 20 storage sections by means of removable dividers. The submitted sample is representative of nine various tackle systems identified as the Plano Molding “Soft Siders.” The tackle systems will be put for sale as a set and will be presented on import packed ready for retail sale as a set. The tackle bag imparts the essential character of the set.

The applicable subheading for style 3364, Soft Sided Tackle System, will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTSUSA), which provides, in part, for travel, sport and similar bags, of textile materials, with outer surface of textile materials, of man-made fibers. The rate of duty will be 17.6 percent ad valorem.

Tariff number 4202.92.3031 falls within textile category designation 670. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
