RE: The tariff classification of a woman’s shirt from Taiwan

Dear Ms. Dairo:

In your letter dated November 15, 2005, you requested a classification ruling. The submitted sample will be returned to you as requested.

Style 62007 is a woman’s shirt that simulates a jacket and a shirt. The outer portion is constructed from 98 percent cotton and 2 percent spandex denim fabric while the inner portion is constructed from 100 percent cotton swiss dot woven fabric. The inner garment extends below the denim outer garment and features a V-neckline, short sleeves and a wrap front opening secured by self-fabric ties. The garment is securely attached at the armholes to the outer component. The outer garment features a V-neckline, long sleeves with cuffs and hook and eye closures, two patch pockets below the waist and a full front opening secured by two hook and eye closures. The essential character is imparted by the denim component.

The applicable subheading for the shirt will be 6211.42.0054, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded from heading 6206: other. The duty rate will be 8.1 percent ad valorem.
