RE: The tariff classification of glow-in-the-dark remote covers from China.

Dear Ms. Marcoux:

In your letter dated November 14, 2005, you requested a tariff classification ruling.

The submitted illustrations depict a sample that is identified as style number 52540, a set of two glow-in-the-dark remote covers. The remote covers are made of a thermoplastic elastomer. The glow-in-the-dark cover stretches to fit most remote control units. Your letter of inquiry states that the cover will glow for approximately one hour. This facilitates finding a remote in a dark room. The cover measures approximately 6 inches long by 2-3/8 inches wide by ¾ inch high. The top is almost completely open to provide access to all of the control buttons. The cover is not in the nature of a container or case but functions as a holder to provide a better grip and increased visibility.

The applicable subheading for the glow-in-the-dark remote covers will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTSUS), which provides forother household articlesof plastics: Other: Other. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
