RE: The tariff classification of a woman’s knit nightdress and a woman’s knit robe from Vietnam.

Dear Ms. Purcell:

In your letter, which we received on dated November 16, 2005 you requested a classification ruling for a woman’s nightdress and robe. The samples will be returned, as requested.

Style A71064 consists of a woman’s nightdress and robe, both constructed from 100% cotton knit fabric. The sleeveless nightdress extends to mid-calf and has a V neckline, picot edging around the neckline and armholes, and a plain, hemmed bottom. The robe is approximately the same length and has a rounded neckline, short sleeves, a full front opening with a zipper closure, patch pockets below the waist, and a plain, hemmed bottom.

Based on the appearance of the garments and the manner in which they will be marketed and sold, they are considered sleepwear of heading 6108.

The applicable subheading for the nightdress will be 6108.31.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for Nightdressesknitted or crocheted: Of cotton. The duty rate will be 8.5 percent ad valorem.

The applicable subheading for the robe will be 6108.91.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for Bathrobesand similar articles, knitted or crocheted: Of cotton. The duty rate will be 8.5 percent ad valorem.

The nightdress falls within textile category designation 351; the robe falls within textile category designation 350.
