RE: The tariff classification of a woman’s knit sweater from China

Dear Ms. Fagundes:

In your letter dated October 25, 2005, you requested a classification ruling. As requested, your sample is being returned to you. This office notes that the production sample you provided with your ruling request appears to contain metallic yarn. You have stated in your letter, however, that style 62122778 will not contain any lurex yarns and will be constructed from 100% rayon fabric. Please note that any change to that fiber content can potentially change the classification and result in this ruling becoming invalid.

Your sample, style 62122778, is a woman’s sweater constructed from 100% rayon knit openwork fabric. The sweater features a V-shaped neckline, cap sleeves, and a 100% polyester lining.

The applicable subheading for style 62122778 will be 6110.30.3020, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: sweaters: women. The duty rate will be 32% ad valorem.
