RE: The tariff classification of costumes from China.

Dear Mr. Williams:

In your letter dated October 25, 2005, you requested a tariff classification ruling.

You submitted photographs of costumes, which meet the flimsy, non-durable requirements for classification in Chapter 95.

Style 02162/12162, Fuzzy Puppy, is a textile costume that consists of a polyester knitted plush jumpsuit and an ethylene vinyl acetate mask, with the jumpsuit imparting the essential character. Although the jumpsuit has three styling features (tail, tummy, sewn-in spots), it has flimsy construction of the neck and seams, a flimsy hook and loop tab closure and raw edges at the arms and ankles.

Style 02713/12713, Fuzzy Cow, is a textile costume that consists of a polyester knitted plush jumpsuit, a polyester kitted plush headpiece and polyester shoe toppers, with the jumpsuit imparting the essential character. Although the jumpsuit has three styling features (tail, tummy, sewn-in spots), it has flimsy construction of the neck and seams, a flimsy hook and loop tab closure and raw edges at the arms and ankles.

Style 02839 A, B & C/12839 A, B & C Lil’ Dino, is a textile costume that consists of a polyester knitted plush jumpsuit, a polyester knitted plush headpiece and polyester shoe toppers, with the jumpsuit imparting the essential character. Although the jumpsuit has three styling features (tail, tummy, sewn-in stripes), it has flimsy construction of the neck and seams, a flimsy hook and loop tab closure and raw edges at the arms and ankles.

The applicable subheading for style 02162/12162, Fuzzy Puppy, style 02713/12713, Fuzzy Cow, style 02715/12715, Fuzzy Puppy, style 02740/12740, Fuzzy Tiger, and style 02839 A, B & C/12839 A, B & C, Lil’ Dino, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other." The rate of duty will be Free.
