RE: The tariff classification of a clutch bag from China

Dear Ms. Fox:

In your letter dated October 14, 2005, you requested a tariff classification ruling. The request is on behalf of Ann Taylor, Inc.

The sample submitted, identified as Style #D32-102804, is a clutch bag with swagger wrist strap. It is wholly covered on the outer surface with a fabric that is made-up of a woven viscose cotton yarns. The viscose yarns have an apparent width under 5mm in width. The fabric consists of 72 % cotton and 28% viscose by weight. The bag has a magnetic flap closure. You have requested sample return. However, the sample has been destroyed on examination and will not be returned.

The applicable subheading for the clutch bag, item D32-102 804, will be 4202.22.4500, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials not of pile or tufted construction, of cotton. The duty rate will be 6.5 percent ad valorem.

Items classified in HTS 4202.22.4500 fall within category designation 369. Based upon international textile trade agreements, products of China are not currently subject to quota and the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
