RE: The tariff classification of two women’s knit cardigans from Macau

Dear Ms. Fox:

In your letter dated October 17, 2005, you requested a classification ruling on behalf of Jones Apparel Group. As requested, your samples are being returned to you.

Style V2530296 is a woman’s cardigan constructed from 95% cotton, 5% spandex knit fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction in which the stitches were formed. The garment features a hood, long sleeves finished with openwork fabric, a full front zippered opening, two slant pockets, and a hemmed bottom that does not provide a tightening at the waist.

Style V2595436K is a woman’s cardigan constructed from 70% cotton, 30% spandex knit fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction in which the stitches were formed. The garment features a hood, long sleeves finished, a full front zippered opening, and a rib knit bottom that does not provide a tightening at the waist.

The applicable subheading for both styles will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: women’s. The duty rate will be 16.5% ad valorem.

Both styles fall within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
