RE: The tariff classification of a woman’s jacket from China

Dear Ms. Day:

In your letter dated October 25, 2005, you requested a classification ruling on behalf of Western Glove Works, Winnipeg, Canada. You state in your ruling request that the submitted sample is a modified version of style J822386. The previous version of style J822386 was the subject of New York Ruling L87085. As requested, your sample is being returned to you.

Style J822386, is a woman’s jacket constructed from 98% cotton, 2% spandex knit fabric. The garment features a drawstring hood, long sleeves with elasticized cuffs, a full front zippered opening, two pouch pockets, and a drawstring bottom.

The applicable subheading for style J822386 will be 6102.20.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ overcoats, carcoats, capes, cloaks, anoraks (including ski-jackets), windbreakers and similar articles, knitted or crocheted: of cotton: women’s. The duty rate will be 15.9% ad valorem.

Style J822386 falls within textile category designation 335. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
