RE: The tariff classification of boys’ swim trunks from China

Dear Mr. Maher:

In your letter that was received by this office on October 7, 2005, written on behalf of Hoop Retail LLC, you requested a classification ruling.

Submitted style D2205B0002, manufactured from woven fabric that you state is coated with polyurethane, is a mesh-lined garment, resembling a pair of shorts, fully elasticized around the waistband through which an adjustable drawstring is threaded and at each side of which an open pocket is located.

As you have requested, the sample garment is being returned.

The applicable subheading for this style will be 6211.11.1020, Harmonized Tariff Schedule of the United States (HTS), which provides for swimwearboys’, of man-made fibers, boys’. The duty rate will be 27.8 per cent ad valorem.

The swim trunks fall within textile category designation 659. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
