RE: The tariff classification of a child’s handbag and wrist band from China

Dear Ms. Davenport:

In your letter dated October 4, 2005 you requested a classification ruling.

You have submitted a sample identified as style number 80943, which consists of a child’s handbag, and a wristband put up for retail sale as a carded rack good. The handbag is wholly of man-made fiber textile materials. The wristband is of a woven mesh fabric that is sewn to a braided elastic polyester fabric. The samples are being returned as requested.

The applicable subheading for the handbag will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTS), which provides, in part, for handbags of textile materials, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem.

The applicable subheading for the wristband will be 6217.10.9530, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up clothing accessories, other than those of heading 6212, accessories, other, other, of man-made fibers. The duty rate will be 14.6 percent ad valorem.

Tariff numbers 4202.22. 8050 and 6217.10.9530 fall within textile category designations 670 and 659, respectively. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
