RE: The tariff classification of a hand blanket and boot blanket from China.

Dear Ms. Frase:

In your letter dated September 28, 2005 you requested a classification ruling. The samples will be returned to you as requested.

Style 621 is a hand blanket (insulated hand muff) composed of woven 60% brushed cotton/40% polyester fabric with an acrylic pile lining. The camouflage muff style item has a textile belt and an adjustable slider buckle. The hand muff is used by hunters to keep their hands warm.

Style 620 is a boot blanket (insulated over boot) composed of the same fabric as the hand muff with a nylon lining coated with polyurethane and a separate plastic sole. The boot blanket is worn over boots by hunters to keep their feet warm when in a tree stand.

The applicable subheading for the hand blanket will be 6217.10.9510, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: Accessories: Other: Other, Of cotton.” The duty rate will be 14.6% ad valorem. The textile category designation is 359.

     The applicable subheading for the over boot, style 620, will be 6404.19.20, Harmonized Tariff Schedule of the United States (HTS), which provides for “Footwear, in which the upper’s external surface area is predominately textile materials (excluding accessories or reinforcements); in which the outer sole’s external surface is predominately rubber and/or plastics; which is not "athletic" footwear; and which is designed to be a protection against water, oil, or cold or inclement weather.” The rate of duty will be 37.5% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
