RE: The tariff classification of a girl’s skirt from Taiwan.

Dear Ms. Williams:

In your letter dated September 23, 2005, you requested a classification ruling for a girl’s dance skirt. The item does not have a style number.

The wrap style skirt is made of sheer, lightweight polyester woven fabric and is designed to be worn over a leotard. The article secures at the waist by means of a fabric tie closure and is sized for girls 10/12.

The applicable subheading for the dancewear skirt will be 6204.53.3020, Harmonized Tariff Schedule of the United States (HTS), which provides for skirts and divided skirts, of synthetic fibers, other, other, girls’. The duty rate will be 16% ad valorem.

The skirt falls within textile category designation 642. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
