RE: The tariff classification of two women’s garments from China.

Dear Mr. Weinrauch:

In your letter dated September 21, 2005 you requested a classification ruling for two women’s garments on behalf of Momentrends. The samples will be returned, as requested.

Style VS65635 is a woman’s top constructed from 69 percent cotton, 31 percent polyamide knit mesh fabric. The top has ¼ inch shoulder straps, a V-neckline in front, and a three-inch fringe at the bottom. The upper back of the garment extends across from side seam to side seam, dipping in the center, and exposing more than half of the back.

Style VS32141 is a woman’s pullover constructed from 100 percent cotton knit fabric. The pullover has a boat neckline, cap sleeves, and a self-finish scalloped bottom. The fabric has more than nine stitches per two centimeters, measured in the direction in which the stitches were formed.

The applicable subheading for style VS65635 will be 6114.20.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for Other garments, knitted or crocheted: Of cotton: Tops: women’s or girls’. The rate of duty will be 10.8 percent ad valorem.

The applicable subheading for style VS32141 will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for pulloversknitted or crocheted: Of cotton: Other: Women’s or girls’. The duty rate will be 16.5% ad valorem.

Styles VS65635 and VS32141 fall within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
