RE: The tariff classification of a “Tote-a-Tot” Travel Accessory from China.

Dear Mr. Spoto:

In your letter dated September 14, 2005, on behalf of Jade Marketing Group LLC, you requested a classification ruling.

The sample submitted is identified as style # TT0001 “Tote-a-Tot”. The item is a travel accessory designed to contain various personal effects during travel. The item is designed to be secured over a rolling suitcase or secured to an infant seat. It is manufactured of 100 percent nylon man-made fiber textile material. Your sample is being returned as requested.

The applicable subheading for style # TT0001, the travel accessory, will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides in part, for other bags and containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem.

HTS 4202.92.9026 falls within textile category designation 670. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
