RE: The tariff classification of a raised pet feeder from Indonesia

Dear Ms. Masternak:

In your letter dated September 1, 2005, on behalf of Cinmar, LP, you requested a tariff classification ruling.

The merchandise is a raised pet feeder that will be placed on the floor in the home. Item number 11735 is the small size and item number 11736 is the large size. Both feeders consist of a rectangular granite top sitting upon four mahogany legs. Resting inside the granite top are two removable, stainless steel bowls.

The applicable subheading for the raised pet feeders will be 7323.93.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for table, kitchen or other household articles and parts thereof, of iron or steelother, of stainless steel, other. The general duty rate will be 2 percent ad valorem.

Articles classifiable under subheading 7323.93.0080, HTS, which are products of Indonesia, may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
