RE: The tariff classification of motocross pants from China.

Dear Ms. Szeto:

In your letter dated September 13, 2005, on behalf of White Bothers, you requested a classification ruling.

The submitted samples, Styles SX1 and MX1, are motocross racing pants constructed of woven 95% nylon, 5% polyester fabric with a small amount of knit fabric in locations requiring extra stretch. Style SX1 features waist adjusters, a heavy duty front zipper closure, inside removable fabric hip panels, a degree of thigh and knee protection, vented rear yoke, knees and lower leg, and leather inner knee heat shields. Style MX1 features waist adjusters, a heavy duty front zipper closure, inside removable fabric hip panels, thigh protection, padded knee and lower front leg protection, vented rear yoke and knees, and carbonized fabric inner knee heat shields.

The applicable subheading for the Styles SX1 and MX1 will be 6211.33.0061, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other garments, men’s or boys’: Of man-made fibers, Other.” The duty rate will be 16 percent ad valorem.

Styles SX1 and MX1 fall within textile category designation 659. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
