RE: The tariff classification of mirrors from China

Dear Mr. Marcoux:

In your letter, dated August 25, 2005, you requested a tariff classification ruling regarding glass mirrors.

The products were described as “Blind Spot Safety Mirrors,” item number 51620. You stated that the imported merchandise will consist of a packaged set of two of these mirrors.

Photographs of the products were submitted with your ruling request. Each article is a small round mirror measuring two and an eighth inches in diameter.

You indicated that the reflecting surface of this mirror is made of glass and that it is framed in Acrylonitrile Butadiene Styrene (ABS) plastics. Item 51620 has a self-adhesive foam tape backing that allows the product to be attached to a surface.

The material submitted with your ruling request describes the product as a “convex mirror, in an angled setting “ that provides a 360 degree view. This material indicates that the product can be attached to an automobile side-view mirror.

The article does not have the form of an automotive rear-view mirror and is not regarded as a rear-view mirror.

The applicable subheading for the mirrors (item 51620) will be 7009.92.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for glass mirrors, whether or not framed: framed: not over 929 cm² in reflecting area. The rate of duty will be 7.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
