RE: The tariff classification of women’s shirts from Hong Kong

Dear Mr. Gunther:

In your letter dated August 19. 2005, you requested a tariff classification ruling on behalf of Christopher & Banks Company. The submitted samples will be returned to you as requested.

Style 6970 is a women’s shirt constructed from 97% cotton and 3% spandex woven fabric. The shirt features a full front opening secured by six buttons, long sleeves with vents at the hem, a shirt collar, two breast pockets, front and rear yokes, a hemmed bottom.

Style 5832 is a women’s shirt constructed from 90% polyester and 10% spandex pile knitted fabric with more than ten stitches per centimeter in both the horizontal and vertical directions. The garment features a notched collar, a full front opening secured by three buttons, long hemmed sleeves and a hemmed bottom.

The applicable subheading for style 6970 will be 6206.30.3040, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of cotton: other: other: other: women’s. The duty rate will be 15.4 percent ad valorem.

The applicable subheading for style 5832 will be 6106.20.2010, Harmonized Tariff Schedule of the United States (HTS), which provides for Women’s shirts knitted or crocheted: Of man-made fibers. The duty rate will be 32 percent ad valorem.

Style 6970 falls within textile category designation 341. Style 5832 falls within textile category designation 639.
