RE: The tariff classification of a man’s jacket from China; Visibly Coated

Dear Mr. Terrell:

In your letter dated August 15, 2005, you requested a classification ruling.

The sample submitted, style number SI2430, is a man’s hip-length jacket that has a shell with the two front panels, the outer portion of the collar and the sleeves composed of a woven 100% polyester fabric, and the entire rear panel which extends slightly onto the outer side portions of the front panels, composed of a finely knit 100% polyester fabric. Both shell fabrics are visibly coated with a polyurethane laminate on the inner surface. The jacket is lined with a mesh 100% polyester fabric.

The jacket has a stand-up collar, a full front opening that is secured by a zipper closure that extends to the top of the collar, long sleeves with a tab secured by a hook and loop fastener on the cuffs and free hanging front and rear yokes. The garment has two front pockets with zipper closures at the waist, an inner pocket with a hook and loop fastener, a zipper opening on the inner portion of the jacket between the placket shell fabric and the lining fabric and a drawcord tightening through the bottom hem. The “Sunice” logo is on the lower portion of the left sleeve and on the rear yoke, and a clear plastic label with the logo “Typhoon” is near the left front pocket.

The sample is being returned to you as you have requested.

The applicable subheading for the jacket will be 6210.40.5020, Harmonized Tariff Schedule of the United States (HTS), which provides for garments, made up of fabrics of heading 5602, 5603, 5903, 5906 or 5907: Other men’s or boys’ garments: Of man-made fibers: Other: anoraks, windbreakers and similar articles. The duty rate will be 7.1 percent ad valorem.

The jacket falls within textile category designation 634. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
