RE: The tariff classification of a girl’s pullover from Macau

Dear Ms. Fox:

In your letter dated August 31, 2005, you requested a classification. As requested, your sample is being returned to you.

The submitted sample, style F54KC133X, is a girl’s long sleeve pullover that is constructed from finely knit 95% cotton, 5% spandex jersey fabric. The garment features a round capped neckline and flared A line body distinguished by a high empire waist with ribbon and bow band above three horizontal tiers of self fabric ruffle like layers that are sewn to the lower part of the garment body. The freely hanging fabric layers are finished with lettuce edging. The sleeve ends have separate fabric at the cuffs with the same ruffle and lettuce edging treatment. The article is a girls’ size 5.

The applicable subheading for style F54KC133X will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for pullovers, and similar articles, knitted or crocheted, of cotton, other, other, women’s or girls’. The duty rate is 16.5% ad valorem.
