RE: The tariff classification of a changing pad from China.

Dear Mr. Weinrauch:

In your letter dated August 30, 2005 you requested a classification ruling on behalf of Impact Imports.

The merchandise at issue, Style #2807DTD, is an infants changing pad. A sample of the pad was submitted with your request. The pad is made from 70 percent cotton and 30 percent polyester knit sherpa fabric. It has a lining made from 100 percent polyester woven fabric. The pad measures approximately 17 x 28.5 inches. One end of the pad has a hood. The hood features an applique of an animal face. The pad folds up and is held together by means of a hook and loop fastener. This pad is not internally fitted or stuffed.

The applicable subheading for the changing pad will be 6304.91.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for other furnishing articles, excluding those of heading 9404: other: knitted or crocheted of cotton. The duty rate will be 5.8 percent ad valorem.

The pad falls within textile category designation 369. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
