RE: The tariff classification of SANI-FLOR RECEPTORS from China

Dear Ms. Ragan:

In your letter dated August 9, 2005, on behalf of Simmons Imports, Inc., you requested a tariff classification ruling.

The merchandise consists of four types of SANI-FLOR RECEPTORS (item numbers Z1900, Z1901, Z1910, and Z1950). They are cast iron floor drains used in restaurant bathrooms and kitchens. Item number Z1900 measures 12 inches by 12 inches with a 6-inch sump depth. Item number Z1901 is also 12 inches square, but with an 8-inch sump depth. Item Z1910 is 8 inches square with a 6-inch sump depth. The fourth type, item number Z1950, is a round receptor with a 12-inch diameter and an 8-inch sump depth. In your letter, you suggest classification of this product under 7325.10.0020, HTS, which provides for other cast articles of iron or steel, catch basins, grates and frames. However, the SANI-FLOR RECEPTORS are more specifically provided for under heading 7324 as sanitary ware and parts thereof, of iron or steel.

The applicable subheading for the SANI-FLOR RECEPTORS will be 7324.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for sanitary ware and parts thereof, of iron or steel, other, including parts. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
