RE: The tariff classification of a commercial curling iron ceramic heater from China.

Dear Ms. Ritchings:

In your letter dated August 2, 2005 you requested a tariff classification ruling. You submitted a sample with your request.

The article in question is a ceramic heater used in commercial beauty establishments to heat multiple curling irons simultaneously, designated “The Ceramic Stove Heater”. Features include a ceramic heating element that maintains a steady 1000 F degree temperature, polished stainless steel base, aluminum frame and housing and a four-foot cord with a grounded plug.

The applicable subheading for the commercial curling iron ceramic heater will be 8419.89.9585, Harmonized Tariff Schedule of the United States (HTS), which provides for Other machinery, plant or laboratory equipment, whether or not electrically heated (excluding furnaces, ovens and other equipment of heading 8514), for the treatment of materials by a process involving a change in temperature such as heating, other than machinery or plant of a kind used for domestic purposes; Other: Other Other: For other materials. The rate of duty will be 4.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
