RE: The tariff classification of CD/DVD Case from China

Dear Ms. Meintzer:

In your letter dated August 02, 2005 you requested a classification ruling. The request is on behalf of Computer Expressions, Inc.

The submitted sample is identified as SKU number 70879. It is a case designed to hold 20 compact discs (CD) or 10 Digital Video Discs (DVD). The case is wholly made-up of an outer surface of man-made fiber textile material that is Backed with a sheeting of plastics. The interior has a lining of plastic sheeting. A coil zipper secures the top lid. The case is carried by means of a self-material top handle and is designed to provide storage, protection, organization and portability for the CD’s or DVD’s. The sample will be returned as requested.

The applicable subheading for the CD/DVD case, item 70879, will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides, in part, for other container or case, of textile materials, with outer surface of textile materials, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem.

Goods classified within HTS 4202.92.9026 falls within textile category designation 670. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
