RE: The tariff classification of a baseball uniform top and pants from China.

Dear Ms. Moore:

In your letter dated August 15, 2005, you requested a classification ruling.

The submitted samples are an adult and youth baseball uniform top and pants constructed of finely knit 100% polyester fabric. The top is a sleeveless garment with oversized armholes. It features a left over right, six button, full front closure, a high V-neckline, hemmed armholes, and a curved hemmed bottom with a curved tail. The pants are ankle length and feature a heavy elasticized waistband, tunneled belt loops, a front zipper with a double snap waist tab, two rear slash pockets, overlock-stitched ankles, and front legs reinforced from the knee to the ankles by two layers of fabric. The garments range from sizes small to extra large.

The applicable subheading for the baseball uniform top will be 6110.30.3050, Harmonized Tariff Schedule of the United States (HTS), which provides for “Sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, Knitted or crocheted: Of man-made fibers: Other: Other: Other: Other: Men’s or boys’.” The duty rate will be 32 percent ad valorem.

The applicable subheading for the baseball uniform pants will be 6114.30.3060, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other garments, knitted or crocheted: Of man-made fibers: Other, Other: Men’s or boys’.” The duty rate will be 14.9 percent ad valorem.

The baseball uniform top falls within textile category designation is 638; the baseball uniform pants fall within textile category designation 659. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
