RE: The tariff classification of boys’ lower body garments from Bangladesh

Dear Ms. Girod:

In your letter dated August 1, 2005, written on behalf of Teams Solutions, you requested a classification ruling.

Submitted style YBCB-009, manufactured from alternating finely knitted panels of fabrics of 100% cotton and of 85% cotton/15% viscose, is a pair of shorts through the fully elasticized waistband of which an adjustable drawstring is threaded.

In order for a classification to be issued for the other submitted styles, additonal information is required, as follows: the size is required for styles 670-0046 and SLC S05BDERA, which fasten together at the waistband as for boys’ wear. The latter style is indicated differently in your request and on its tag; this must be clarified.

You refer to styles Orleans and Macon as for boys’ wear; however they fasten together at the waistband as for girls’ wear. Please clarify.

The applicable subheading for the shorts will be 6103.42.1070, Harmonized Tariff Schedule of the United States (HTS), which provides for boys’shorts (other than swimwear), knittedof cotton, shorts, boys’, other. The duty rate will be 16.1 percent ad valorem.

The shorts fall within textile category designation 347. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. In addition, you will find current information on textile import quotas, textile safeguard actions and related issues at the web site of the Office of Textiles and Apparel, at otexa.ita.doc.gov.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
