RE: The tariff classification of a men’s knit vest from China.

Dear Ms. Whitley:

This ruling replaces NY L85837 that was issued to you on July 22, 2005. In that letter, the fiber content of Style 34141 was said to be 100% wool. In a letter dated August 16, 2005, you stated that the fiber content of the garment has changed to 50% wool, 50% polyester. No other changes have been made to the garment. The correct classification is shown below.

Style 34141 is a men’s vest constructed from 50 percent wool, 50 percent polyester, jersey knit fabric that measures 13 stitches per two centimeters counted in the horizontal direction. Style 34141 has an intarsia knit front panel and features a V-neckline, oversized armholes, and a rib knit bottom. The neckline, and the armholes are finished with rib knit edging.

The applicable subheading for Style 34141 will be 6110.30.1530, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man made fibers: other: containing 23 percent or more by weight of wool or fine animal hair: vests, other than sweater vests: men’s or boys’. The rate of duty is 17 per cent ad valorem.

Style 34141 falls within textile category designation 459. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
