RE: The tariff classification of infants’ items from China

Dear Ms. Malina:

In your letter dated July 22, 2005 you requested a classification ruling.

Submitted style 44385 “Infant Gift” set is comprised of infants’ garments and a blanket that are packaged within tissue paper in a gift box. The garments, manufactured from finely knitted fabric of 100% cotton, are a rolled-edge cap and a long-sleeved, long-legged, footed, round-necked garment that fastens together by means of snaps around the inner sides of the legs and at the center of the front. The blanket, manufactured from the same fabric as are the garments, is an approximate 32 inch square.

As you have requested, the sample style is being returned.

The applicable subheading for the garments of this style will be 6111.20.6030, Harmonized Tariff Schedule of the United States (HTS), which provides for babies’ garments and clothing accessories, knitted, of cotton, other, other, other, imported as parts of sets; and for the blanket of this style will be 6301.30.0020, HTS, which provides for blankets (other than electric blankets) and traveling rugs, of cottonother. The duty rates will be 8.1 and 8.4 percent ad valorem, respectively.

The garments fall within textile category designation 239 and the blanket within 369. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
