RE: The tariff classification of a woman’s padded sleeveless jacket from China

Dear Ms. Manguso:

In your letter dated July 15, 2005, you requested a classification ruling.

The sample submitted, style number H08662, is a woman’s hip-length padded sleeveless jacket constructed of a shell composed of a woven 100% silk fabric. The garment is lined with a woven 100% polyester fabric and has a nonwoven polyester batting fill.

The padded sleeveless jacket has oversized armholes, a stand-up collar and a full front opening secured by a zipper closure. The garment also has two front in-seam pockets below the waist and a straight cut bottom hem. The padded sleeveless jacket features embroidered flowers decorated with beading and embroidered stems with leaves along the length of the left front panel, on the upper portion of the right front panel and on the right portion of the rear yoke.

The applicable subheading for the padded sleeveless jacket will be 6202.99.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ anoraks, windbreakers and similar articles (including padded, sleeveless jackets): of other textile materials: Containing 70 percent or more by weight of silk or silk waste. The rate of duty is free.

The padded sleeveless jacket falls within textile category designation 735. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
