RE: The tariff classification of travel bags, plastic bowls, fleece mat and a water bottle and from China.

Dear Ms. Martinez:

In your letter dated July 14, 2005, you requested a classification ruling.

The sample submitted is identified as a “Pet Travel Kit”. No style number was submitted. The item consists of a travel bag of polyester man-made textile material, two plastic bowls for food and water, double-sided fleece mat, a plastic water bottle and a zippered travel (food) bag of vinyl.

You have indicated that the travel bags, food and water bowls, fleece mat, and water bottle will be put up for retail sale as a set. However, for classification purposes the items are not considered to be a set. Each item will be separately classified.

Your samples are being returned as requested.

The applicable subheading for the travel bag of polyester will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate will be 17.6 percent ad valorem.

The applicable subheading for the plastic food and water bowls will be 3924.90.5500, HTS, which provides for other household articles of plastics; other: The duty rate will be 3.4 percent ad valorem.

The applicable subheading for the double sided fleece mat will be 6307.90.9889, HTS, which provides for other made up textile articles, other. The duty rate will be 7 percent ad valorem.

The applicable subheading for the plastic water bottle will be 3926.90.9880, HTS, which provides for other articles of plastics, other. The duty rate will be 5.3 percent ad valorem.

The applicable subheading for the zippered travel (food) bag of vinyl plastic will be 4202.92.4500, HTS, which provides for travel, sports and similar bags, with outer surface of sheeting of plastic, other. The duty rate will be 20 percent ad valorem.

We are unable to issue a classification ruling for the “Draw Cord Food Bag”. Your request for a classification ruling should include an actual sample of the item in condition as being imported. When this information is available, you may wish to resubmit your request for a classification ruling.

HTS 4202.92.3031 falls within textile category designation 670. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
