RE: The tariff classification of a woman’s garment from China.

Dear Mr. Kamnitz:

In your letter dated July 18, 2005, you requested a classification ruling for a garment on behalf of Loyaltex Apparel, Limited. The garment will be returned, as requested.

Style 5S809 is a woman’s garment, which you refer to as a shrug, constructed from 55 percent cotton, 45 percent acrylic knit fabric. The upper body garment extends from the shoulders to approximately two inches above the waist in back, has long sleeves, and a full front opening with a one button closure just above the bust. The garment has minimal front coverage.

The applicable subheading for style 5S809 will be 6114.20.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for Other garments, knitted or crocheted: Of cotton: Other: women’s or girls’. The duty rate will be 10.8% ad valorem.

Style 5S809 falls within textile category designation 359. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
