RE: The tariff classification of a rug from India.

Dear Mr. Skidmore:

In your letter dated July 1, 2005 you requested a classification ruling on behalf of Potpourri Group Inc.

You submitted a sample of a flat woven rug. The rug is hand woven in the “Kelem” style with wool yarns in the weft and cotton yarns in the warp. The warp yarns extend to form a 3-inch hand knotted fringe at each end. The rug measures approximately 24.5 by 50 inches exclusive of the knotted fringe.

The applicable subheading for the rug will be 5702.10.9010, Harmonized Tariff Schedule of the United States (HTS), which provides for carpets and other textile floor coverings, woven, not tufted or flocked, whether or not made up, including “Kelem”, “Schumacks”, “Karamanie” and similar hand-woven rugs: other of wool or fine animal hair. The duty rate will be Free.

The rug falls within textile category designation 465. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
