RE: The tariff classification of trouser/knee hi socks and tights from China.

Dear Mr. Mento:

In your letter dated August 5, 2005, on behalf of Universal Hosiery, you requested a classification ruling.

The submitted sample style TAT3001 are trouser socks/knee hi socks composed of knit 97% nylon and 3% spandex fabric. The item is a flat textured yarn and may be a ribbed yarn. The decitex measurement of the nylon is 77.8 or 70 denier.

Style 5202SY are girls’ cable knit tights composed of knit 85% polyester, 10% nylon and 5% spandex fabric. The decitex measurement of the tights is 83.3 or 75 denier.

 The applicable subheading for the trouser/knee hi socks, style TAT3001 will be 6115.93.9020, Harmonized Tariff Schedule of the United States (HTS), which provides for " Panty hoseknitted or crocheted: Panty hose and tights: Other: Of synthetic fibers: Other: Other, Other." The duty rate will be 14.6% ad valorem. The textile category designation is 632.

The applicable subheading for the tights, Style 5202SY will be 6115.12.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for "Panty hosehosieryOther: Of synthetic fibers, measures per single yarn 67 decitex or more: Other." The duty rate will be 14.9% ad valorem. The textile category designation is 659.
