RE: The tariff classification of the 3-Peg Seaside Wall Plaque with Clock from China

Dear Ms. Marcoux:

This is in response to your letter dated June 28, 2005, requesting a tariff classification ruling on the 3-Peg Seaside Wall Plaque with Clock from China.

The 3-Peg Seaside Wall Plaque with Clock, item number 50520, is a clock that is housed in a case consisting of a whitewashed plaque with simulated bead board paneling. The article measures approximately 12 inches in length by 6¾ inches in width by 2½ inches in depth. The 3-Peg Seaside Wall Plaque with Clock features an analog clock with a battery powered quartz movement. The clock requires one “AA” battery, which is not included. The case has three wooden pegs for holding key rings and similar small items, and it is accented with three- dimensional seaside designs.

The applicable subheading for the 3-Peg Seaside Wall Plaque with Clock will be 9105.21.80, Harmonized Tariff Schedule of the United States (HTS), which provides for wall clocks; electrically operated; other. The rate of duty will be 30 cents each plus 6.9 percent ad valorem on the case plus 5.3 percent ad valorem on the battery.

This ruling is being issued under provision of Part 177 of the Customs Regulations (19 CFR Part 177).
