RE: The tariff classification of a bag from China

Dear Ms. Schachner:

In your letter dated June 30, 2005, received via fax, you requested a tariff classification ruling.

The submitted sample is a bag that measures approximately 24” x 39” and weighs 1.135 kilograms. It is constructed of 100 percent woven uncoated polypropylene strips. The strips meet the dimensional requirements of man-made fiber textile strips contained in Section XI, Legal Note 1(g) of the Harmonized Tariff Schedule of the United States (HTS). The bag is open on one end and is sewn shut on the other end.

The applicable subheading for the bag will be 6305.33.0010, HTS, which provides for sacks and bags of a kind used for the packing of goods: Of man-made textile materials: Other, of polyethylene strip or the like, weighing one kilogram or more. The rate of duty will be 8.4 percent ad valorem.

HTS 6305.33.0010 falls within textile category designation 669. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
