RE: The tariff classification of a bedspread from Pakistan and the Philippines.

Dear Mr. Pilon:

In your letter dated June 9, 2005 you requested a classification ruling on behalf of Medline Industries, Inc.

The submitted samples, identified as “Serpentine Snag-Less Thermal Spreads”, item number MDT218225WHIR and MDT218222WHIR, are bedspreads. Item number MDT218225WHIR is made from 55 percent cotton and 45 percent polyester woven fabric. It measures 66 x 90 inches. Item number MDT218222WHIR is made from 100 percent cotton woven fabric. It measures 72 x 96 inches. One bedspread features a decorative zigzag pattern. The other bedspread has a decorative twill pattern. Both spreads are hemmed at the top and bottom and have exposed selvedge on the sides. They do not contain any embroidery, lace, braid, edging, trimming, piping or applique work. Both items are principally used as bedspreads by hospitals and nursing homes The applicable subheading for the bedspread will be 6304.19.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for other furnishing articles, excluding those of heading 9404: other: of cotton: other. The duty rate will be 4.4 percent ad valorem.

The bedspreads fall within textile category designation 362. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
