RE: The tariff classification of gloves from China.

Dear Ms. Irish:

In your letter dated June 6, 2005, you requested a tariff classification ruling on behalf of your customer, Sportsman’s Warehouse.

Style 4SWWS2 is a glove that is half-fingered with the exception of the thumb. The glove features a sewn-on mitten style cover that can be placed over the fingers or secured with hook and loop fasteners when not in use. The glove is constructed of a three-layer fabric consisting of a laminated membrane sandwiched between two knitted polyester fabrics. Coated fabric reinforcements are located at the center of the palm extending to the thumb and at the thumb/forefinger crotch extending up the edges of both fingers. Additional features include a hook and clasp, fourchettes, a partially elasticized wrist, and a fabric trimmed cuff. You asserted classification as a ski glove and a letter from Sportsman’s Warehouse also states that the gloves can be used for outdoor activities such as hunting, fishing, camping, hiking and snowshoeing. We find the subject merchandise does not have any special characteristics which evidence primary use for the outdoor activities you have indicated. In this regard, we find the glove to be a multi-use cold weather glove.

The applicable subheading for style 4SWWS2 will be 6116.93.9400, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts, knitted or crocheted: other: of synthetic fibers: other: other: with fourchettes. The duty rate will be 18.6 percent ad valorem.

The glove falls within textile category designation 631. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
