RE: The tariff classification of “Click Chick Fashion Playsets” from China.

Dear Ms. Aldinger:

In your letter dated May 6, 2005, you requested a tariff classification ruling.

Two samples were provided with your letter. The samples vary in some details from the description provided in your letter. This ruling is based on the samples. Both samples are identified as “Click Chick Fashion Playsets,” though the imported products will be marketed as “Angels Fashion Playsets.” The first sample consists of a molded plastic carry case decorated with flowered material, a plastic photo frame, three plastic bangle bracelets and two plastic rings. The second sample consists of a molded plastic iridescent carry case, one plastic beaded bracelet, two plastic rings, a pair of plastic earrings, and a plastic photo frame. As you requested, the samples will be returned.

The applicable subheading for the plastic bracelets, plastic earrings and plastic rings will be 7117.90.7500, HTS, which provides for imitation jewelry: other: other: valued over 20 cents per dozen pieces or parts: other: of plastics. The rate of duty will be free.

The applicable subheading for the plastic photo frames will be 3924.90.5500, HTS, which provides for tableware, kitchenware, other household articles and toilet articles, of plastics, other, other. The rate of duty will be 3.4 percent ad valorem.

The applicable subheading for the molded plastic carry cases will be 3926.90.9880, HTS, which provides for other articles of plastics, other. The rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
