RE: The tariff classification of a hat from China.

Dear Mr. Ashear:

In your letter dated May 27, 2005 you requested a classification ruling. The sample will be returned to you as requested.

The submitted sample, style 2129 is a bucket style hat composed of knit fleece polyester fabric. The hat features stitching on the outside creating a box effect.

The applicable subheading for style 2129 will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabricOther: Of man-made fibers: Knitted or crocheted or made up from knitted or crocheted fabric: Not in part of braid, Other: Other: Other. The duty rate will be 20 cents per kilogram plus 7% ad valorem. The textile category designation is 659.
