RE: The tariff classification of a woman’s suit-type jacket from China

Dear Ms. Evans:

In your letter dated May 24, 2005, you requested a tariff classification ruling. Your sample is being returned as requested.

The submitted sample, style number 8998, is a woman’s tailored suit-type jacket that is constructed from 100% wool, cable knit fabric. The garment consists of three panels, two of which are in front. The three panels are sewn together lengthwise. The jacket features a notched-lapel collar, long sleeves with three button closures at the wrist, a full front opening with a two-button closure, a left chest pocket, two front patch pockets at the waist, and a hemmed bottom.

The applicable subheading for the suit-type jacket will be 6104.31.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s suit-type jackets, knitted: of wool or fine animal hair. The rate of duty will be 54.8 cents/kg + 16% ad valorem.

The suit-type jacket falls within textile category designation 435. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
