RE: The tariff classification of a Touch Screen LCD Monitor from China.

Dear Mr. Kavanaugh:

In your letter dated May 20, 2005, on behalf of your client Infynia you requested a tariff classification ruling.

The merchandise under consideration is the Infynia OTL15J LCD (Liquid Crystal Display) Monitor. The OTL15J is a 15” active matrix TFT (Thin Film Transistor) LCD with an aspect ratio of 4 x 3. A sample of the OTL15J was submitted with your ruling request and will be returned to you.

The submitted sample and accompanying literature indicates that this monitor is a touch screen monitor for the Touch Tunes Digital Jukebox “Rhapsody.” The touch screen provides an easy way for the user to view and select the desired music from a vast library of songs. The sample features a metal frame with the LCD and necessary electronics. The monitor features an analog input video format with a Mini D-Sub 15-Pin female connector. Two additional printed circuit assemblies (PCA) are mounted on the back of the metal frame and feature several switches and connectors.

In your letter you suggest classification under either heading 8522 Harmonized Tariff Schedule of the United States (HTS), which is for parts and accessories solely for sound reproducing apparatus or under heading 9013 HTS, which is for liquid crystal displays and other optical appliances. However, this office believes that the OTL15J monitor is integral to the control and operation of the Touch Tunes Digital Jukebox. The OTL15J touch screen LCDs function as control panels. They incorporate PCAs, and multiple switches and connectors of heading 8536 HTS. The LCD touch screen, whose principal use is for the electric control of the jukebox, is properly classified under heading 8537.

The applicable subheading for the Infynia OTL15J LCD Monitor will be 8537.10.9070, Harmonized Tariff Schedule of the United States (HTS), which provides for “Boards, panels, consoles, desks, cabinets and other bases, equipped with two or more apparatus of heading 8535 or 8536, for electric control or the distribution of electricityFor a voltage not exceeding 1,000 V: Other: Other: Other.” The general rate of duty will be 2.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
