RE: The tariff classification of a woman’s jacket from China, Taiwan and the Philippines

Dear Ms. Casler:

In your letter dated May 23, 2005, on behalf of Ashworth, Inc., 2765 Loker Avenue West, Carlsbad, CA 92008, you requested a tariff classification ruling. Your sample is being returned as requested.

The submitted sample, style WM 70047 is a woman’s jacket that is constructed from a woven micro fiber fabric (the front and back panels) that is bonded to a100% polyester knit pile fabric (the inside surface). The sleeves are constructed from 50% wool, 50% acrylic, knit fabric with a jersey knit lining.

The jacket features a mock collar, long sleeves with turn-back cuffs, a full front opening with a zipper closure, front inset vertical pockets in the waist area, and a hemmed bottom. An “Ashworth” appliqué is sewn in the area of the left pocket.

The tariff classification of this garment is governed by the rules used to classify its fabric; Legal Note 1(c), Chapter 60, HTS, noted.

The applicable subheading for the jacket will be 6102.30.2010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s overcoatswindbreakers and similar articles, knitted, other than those of heading 6104: of man-made fibers: other: women’s. The rate of duty will be 28.2% ad valorem.

The jacket falls within textile category designation 635. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
