RE: The tariff classification of a lawn sign from China.

Dear Ms. Gonzales:

In your letter dated May 5, 2005, you requested a tariff classification ruling. A description, photos, and a small piece of constituent material accompanied your inquiry.

The article in question, identified as a “birth announcement yard sign,” consists of a 3 x 6 foot, irregularly shaped plastic panel (extruded to resemble corrugated cardboard) that has been printed with the words “It’s a Girl!” The sign also incorporates a picture of a teddy bear and spaces for entry of the baby’s name, birth date and weight. A metal ground stake will accompany the sign, enabling it to be supported and displayed in front of a home.

Your inquiry mentions subheading 9505.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for certain “festive articles,” as a possible classification for this product. However, for tariff purposes births and birthdays are not “festive” occasions recognized in heading 9505, HTS.

The applicable subheading for the sign will be 4911.99.8000, HTS, which provides for other (non-enumerated) printed matter. The rate of duty will be Free. (There are currently no quotas or quota categories associated with this tariff number.)

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
