RE: The tariff classification of a woman’s suit-type jacket from China

Dear Mr. LoPresti:

In your letter dated May 6, 2005, on behalf of Lisli LLC, you requested a tariff classification ruling.

The submitted sample, style 508/28004, is a woman’s tailored suit-type jacket that is constructed from 100% cotton, knit fabric with sequins. The suit-type jacket is made with more than three panels of which two are in the front, sewn together lengthwise. You stated in a telephone conversation with the National Import Specialist Associate that the first three digits of the style number will change according to what month the garments will be imported, i.e. 508/28004 (August), 509/28004 (September)and that the last five digits (28004) will be consistent.

The jacket features a notched lapel collar, ¾ inch long sleeves, a full front opening with 3 button closures, and princess seams.

The applicable subheading for the suit-type jacket will be 6104.32.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s suit-type jackets, knitted: of cotton. The rate of duty will be 14.9% ad valorem.

The suit-type jacket falls within textile category designation 335. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
