RE: The tariff classification of hats from China.

Dear Ms. Hu:

In your letter dated May 13, 2005 you requested a classification ruling. The samples will be returned to you as requested.

Three samples of hats were submitted with your request. Style 9298, Driving Cap is composed of woven 100% camel hair fabric. The hat is a solid color cap with a snap peak.

Style 9397, Driving Cap is composed of woven 100% wool fabric. The hat is a cap with a snap peak in hounds tooth design.

Style 9734, Driving Cap is composed of woven 100% wool fabric. The hat is a plaid design with no definitive peak.

All three styles will be imported in men’s, ladies, unisex and junior sizes.

The applicable subheading for style 9298 will be 6505.90.9045, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: Other: Other, Other: Of fine animal hair.” The duty rate will be 20.7 cents/kg + 7.5% ad valorem. The textile category designation is 459.

The applicable subheading for styles 9397 and 9734 will be 6505.90.4090, Harmonized Tariff Schedule of the United States Annotated (HTSUSA), which provides for “Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hairnets of any material, whether or not lined or trimmed: Other: Of wool: Other.... Other: Other.” The rate of duty will be 31 cents per kilogram plus 7.9 percent ad valorem. The textile category designation is 459.
