RE: The tariff classification of two types of tennis ball felt material, from either Thailand or China.

Dear Mr. St. Clair:

In your letter dated May 6th and Fax of May 18, 2005, you requested a tariff classification ruling.

Two representative samples were submitted, which were identified as types “W” and “N”, respectively.

Type “W” consists of a woven material which is composed of a 58% wool/40% nylon man-made fiber/2% cotton blend. This woven material has been fulled to force the yarns tightly together and then napped to produce a felt-like appearance. The nylon fibers that are incorporated in this material appear to be staple. You state that this material weighs 20 to 24 ounces per square yard.

Type “N” consists of a loosely woven textile scrim that has had textile fibers needled through and then, built up, to form a substantial felt material. This construction is, by definition a needleloom felt. You state that this material is composed of a 51% nylon/45% wool/4% polyester man-made fiber blend. Your letter indicates that this material weighs 18 to 22 ounces per square yard.

Both of these materials will be imported as roll goods.

The applicable subheading for the type “W” material will be 5111.30.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for woven fabrics of carded wool or carded fine animal hair, other, mixed mainly or solely with man-made staple fibers, other. The duty rate will be 25 percent ad valorem.

The applicable subheading for the type “N” material will be 5602.10.9090, Harmonized Tariff Schedule of the United States (HTS), which provides for needleloom felt and stitch-bonded fiber fabrics, of other than wool or fine animal hair. The duty rate will be 10.6 percent ad valorem

The woven product designated “W” falls within textile category designation 410. The needleloom felt material designated “N” falls within textile category designation 223. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
