RE: The tariff classification of a capelet/shawl from China.

Dear Ms. Dairo:

In your letter dated May 2, 2005 you requested a classification ruling. The sample will be returned to you as requested.

The submitted sample, style 58409 is a capelet/shawl composed of 55% acrylic/45% cotton fabric. The capelet/shawl has a full front opening with one button closure, and does not cover the elbows or extend to the waist.

The applicable subheading for the capelet/shawl, style 58409 will be 6117.10.2030, Harmonized Tariff Schedule of the United States (HTS), which provides for "Other made up clothing accessories, knitted or crochetedShawlsand the like: Of man-made fibers, Other." The duty rate will be 11.3% ad valorem. The textile category designation is 659.
